What is fibromyalgia?

The main symptom of fibromyalgia is muscle aches, and therefore this disease has also been given the name muscle aches. In addition, there is a wide range of accompanying symptoms, including headaches, chronic fatigue, sleep disorders, gastrointestinal dysfunction, memory problems, and more. The roots of fibromyalgia are unclear, and the symptoms experienced by patients can vary from person to person. Also, the disease can not be diagnosed through blood tests or x-rays but by eliminating other conditions that cause the symptoms. Common to all sufferers of this syndrome, however, is functional impairment. Can a person with fibromyalgia file a disability claim with Social Security?

Social Security and Fibromyalgia

Receiving a disability pension from the National Insurance Institute due to a medical disability generally requires that the same disease appears in the list of conditions and disabilities in the regulations for which the percentage of medical disability is determined. Fibromyalgia is not included in this list. However, sufferers may be entitled to an allowance according to the percentage of disability determined in the registry for a similar medical disability, for example, anemia, due to the similarity in some of the symptoms. It is important to note that proving the claim is not a simple matter because it is difficult to assess the degree of disability in a disease characterized mainly by pain and which has no findings on blood tests or photographs.

General Disability Claim

People with Fibromyalgia are entitled to file a general disability claim, which must be attached to medical documents that reflect the patient’s condition and, above all, the opinion of a rheumatologist. After filing the claim, the insured will receive a summons to a medical committee, determining the degree of medical disability and the degree of incapacity. To receive a monthly pension, a certain percentage threshold must be passed in these two parameters, depending on the circumstances of the case (40%, 50%, or a minimum of 60% disability percentage and 50% loss of fitness at least). Also, those who have been determined to have at least 20% permanent medical disability will not be able to receive an annuity but will be entitled to other rights such as vocational rehabilitation.
