Accident hit and run - compensation from Karnit Corporation
Unfortunately, quite a few of the car/road accidents involving pedestrians are hit-and-run accidents in which the offending driver flees the scene. Apart from the fact that this act is a criminal offense, the same driver prevents the victim from receiving compensation from the insurance company, since his identity is unknown. In this situation, the injured party must contact the Karnit corporation, which will replace the insuring body and pay the injured party monetary compensation for the physical damage caused to him due to the accident.

Karnit Corporation
It is a public body established by law, whose function is to pay monetary compensation to victims of car/road accidents, who are not entitled to compensation from another insurance company. For example, in the case of a hit-and-run accident, in which the identity of the driver is unknown because he fled the scene of the accident. In this situation, the injured party does not have an address for the claim because he does not know who the insurance company that insures the offending driver is. Karnit is a statutory corporation funded by the public, through compulsory insurance, with part of the premium we pay passed to that corporation. In the event such as a hit-and-run accident, Karnit will operate in the insurance company’s cap and compensate the injured party in a road accident. It is important to emphasize that compensation is given for bodily injury only and not for property damage. Bodily harm is physical harm and even mental harm. As will be seen below, the injured party’s entitlement to payment from the Karnit Corporation is conditional on him having acted to locate the driver and only if he has tried and failed to do so, will he be able to receive compensation.
The reasonable diligence test
Eligibility for financial compensation from Karnit is not automatic. It is conditional on the victim proving to the corporation that he has taken reasonable steps to locate the offending driver. The rationale for this condition is to prevent victims of accidents hit and run from stagnating, knowing that they will be able to receive monetary compensation even without the details of the driver and the body insuring him. How do Karnit decide whether the victim acted to locate the driver or not? According to the reasonable diligence test, in which they examine whether the victim tried to locate witnesses at the scene of the accident and obtain their details, whether he photographed the scene of the accident, reported the accident to the police, etc. If the victim did not meet this burden, it is very possible that his claim for compensation will be rejected.
Other cases in which Karnit will compensate victims of road accidents
Karnit compensates victims of road accidents who are not entitled to compensation from any insurance company. Examples of such cases are passengers injured while driving when the driver of the vehicle does not have a proper driver’s license, no valid compulsory insurance, or a valid vehicle license, or a pedestrian injured in similar circumstances – when the driver does not have a valid license, or when the vehicle is unlicensed or uninsured.
It is important to note that the driver himself in all those cases is not compensated. Karnit will not compensate a person who by his default caused him not to be legally insured with compulsory insurance.
Additional persons entitled to compensation from Karnit are those who depend (usually first-degree family members) on a driver who was killed in a car accident, but he himself was not entitled to compensation from an insurance company or Karnit due to the reasons listed above. His dependent family, who are now left without him, will be entitled to sue Karnit and receive compensation.
